Public auctions and court distrainers auctions

A creditor has the possibility to settle a claim not only with the help of a court distrainer, but also with a system of public auctions. In my opinion, the first option is much more used because the public does not know the advantages of public auctions. In my bachelor's thesis I compare the public auctions under the Act on Public Auctions to the court distrainer auctions under the Civil Procedure Code and Execution Procedure. In the first and second part I describe both auction systems. In the other part I highlight the major differences of both systems. In the last part I assess chosen elements, explain the advantages and disadvantages of both systems and suggest possible modifications for greater effectiveness of the auctions.
The comparison of encashment of a real estate according to different laws

This bachelor's thesis is focused on comparison of different laws that affect auctions in our legal system, specifically on: Act on Public Auctions, Execution Procedure, Civil Procedure Code, Civil Code and Tax Code. It also handles the issue of finding the differences between specific concepts of law that define different types of auctions in our legal system. This thesis brings the most important differences between all legal processes mentioned.

Bakalářská práce se prioritně snaží poskytnout nezasvěcenému občanovi pohled do světa exekucí a naznačit řešení jejich konkrétních případů. V teoretické části popisuje fungování exekučního procesu z pohledu zákona a v praktické části jsou uvedeny různé případy ze života. Cílem praktické části bylo zhodnotit svět exekucí jako takový a navrhnout řešení Katčinho problému.
The Analysis of Function of Executors in the Czech Republic

The priority of the thesis is to evaluate economic reason for the existence of executors in comparison with current institute of state bailiffs. The thesis further analyzes the powers of executors and their potential misuse in the execution process. Last but not least, the state regulations of this institute are described. The goal is to use general economic theory to find out the effective way of protecting creditor's rights.
